2025 Special Election

The Victoria Firefighter’s Association presented a petition seeking “Adoption of the fire fighters’ and police officers’ civil service law for the Victoria Fire Department;” and “Adoption of the state law applicable to fire fighters that establishes collective bargaining if a majority of the affected employees favor representation by an employees’ association, preserves the prohibition against strikes and lockouts, and provides penalties for strikes and lockouts.”  Texas Local Government Code Chapters 143 and 174 outline the process for submitting a petition to place this item on the ballot and the required ballot language. 

Chapter 143, section 004 (b) states If the governing body of the municipality receives a petition requesting an election that is signed by a number of qualified voters of the municipality equal to at least 10 percent of the number of voters who voted in the most recent municipal election, the governing body shall order an election submitting to the voters the question of whether this chapter should be adopted.  The election must be held on the first authorized uniform election date prescribed by Chapter >41, Election Code, that occurs after the petition is filed and that allows sufficient time to comply with other requirements of law.

Chapter 174, section 051 (a) states The governing body of a political subdivision to which this chapter applies shall order an election for the adoption of this chapter on receiving a petition signed by qualified voters of the political subdivision in a number equal to or greater than the lesser of: (1)  20,000; or (2)  five percent of the number of qualified voters voting in the political subdivision in the preceding general election for state and county officers."

After verifying the required elements of a petition from Chapter 277 of the Texas Election Code and the number of signatures as required by the regulating chapters of the State regulations, it was determined that the requirements of all chapters were met, and the petition was sufficient. Based on Texas Local Government Code Chapter 143.004(a) and Chapter 174.05, the City of Victoria may hold an election on November 4, 2025 to adopt the chapters.

La Asociación de Bomberos de Victoria presentó una solicitud para «la adopción de la ley de función pública para bomberos y agentes de policía del Departamento de Bomberos de Victoria» y «la adopción de la ley estatal aplicable a los bomberos que establece la negociación colectiva si la mayoría de los empleados afectados están a favor de la representación por parte de una asociación de empleados, mantiene la prohibición de huelgas y cierres patronales, y establece sanciones para huelgas y cierres patronales». Los capítulos 143 y 174 del Código de Gobierno Local de Texas describen el proceso para presentar una solicitud para incluir este tema en la boleta electoral y el texto que debe aparecer en ella.

El capítulo 143, sección 004 (b) establece que «Si el órgano rector del municipio recibe una solicitud para celebrar elecciones firmada por un número de votantes cualificados del municipio equivalente al menos al 10 % del número de votantes que votaron en las últimas elecciones municipales, el órgano rector ordenará la celebración de elecciones en las que se someterá a los votantes la cuestión de si debe adoptarse este capítulo. Las elecciones deberán celebrarse en la primera fecha electoral uniforme autorizada prevista en el capítulo 41 del Código Electoral, que se produzca después de presentarse la solicitud y que permita tiempo suficiente para cumplir con los demás requisitos legales.

El capítulo 174, sección 051 (a) establece que «El órgano rector de una subdivisión política a la que se aplica este capítulo ordenará la celebración de elecciones para la adopción de este capítulo al recibir una solicitud firmada por votantes cualificados de la subdivisión política en un número igual o superior al menor de los siguientes: (1) 20,000; o (2) el cinco por ciento del número de votantes calificados que votaron en las elecciones generales anteriores para cargos estatales y del condado en dicha subdivisión política».

 Tras verificar los elementos necesarios de una solicitud según el capítulo 277 del Código Electoral de Texas y el número de firmas requerido por los capítulos reguladores de las normas estatales, se determinó que se cumplían los requisitos de todos los capítulos y que la solicitud era válida. De conformidad con el Capítulo 143.004(a) y el Capítulo 174.05 del Código de Gobierno Local de Texas, la ciudad de Victoria podrá celebrar elecciones el 4 de noviembre de 2025 para adoptar los capítulos.
