The City of Victoria requires all local Mobile Food Vendors to obtain a Mobile Food Vendor Permit from the Fire Marshal’s Office. Mobile Food Vendors from outside of Victoria County are required to purchase a City of Victoria Mobile Food Vendor permit. All permits expire on January 31st of the next permit year. Please review the steps listed below to obtain a permit.
Per City of Victoria ordinance code: Section 14-50
Mobile Food Vendor: Any food establishment that prepares, serves, sells, or distributes any food or beverage from a mobile food preparation vehicle that is not operating at a permanent fixed location within the City of Victoria in accordance with Section 14-60 herein. The term shall include, but not be limited to:
(1) Mobile food truck or vehicle: a food establishment that prepares, serves, sells, or distributes any food or beverage from a mobile food preparation vehicle that is not operating at a permanent, fixed location;
(2) Concession carts: self-contained units that must be moved by non-motorized means and which only sell prepackaged food and beverages, or food and beverages which are non-refrigerated; or
(3) Concession truck or trailer: a trailer or vehicle-mounted unit capable of being readily moveable, fully self-contained, and may sell limited menu items including, but not limited to, hot dogs, corn dogs, nachos, corn, popcorn, pretzels, snow cones, funnel cakes, tea, lemonade, or prepackaged foods.
This includes: Mobile food preparation vehicles that are equipped with appliances that produce smoke or grease-laden vapors for the purpose of preparing, cooking or serving food. (2024 International Fire Code 4106.1)
Per City of Victoria ordinance code; Section 14-59
It is an offense to operate as a Mobile Food Vendor within the City of Victoria without having a currently valid Mobile Food Vendor permit issued by the City Fire Marshal. Any person desiring to operate as a Mobile Food Vendor shall apply for each vehicle or unit used as a Mobile Food Vendor.
Step 1
Complete the City of Victoria Mobile Food Vendor Permit Application (PDF). Copies can be picked up at the Victoria Fire Marshal’s Office or complete the online application to become a mobile food vendor.
Step 2
Schedule an inspection with the Victoria Fire Marshal’s Office by calling 361-485-3460. Inspections are conducted by appointment only on Thursday mornings.
Step 3
Submit the Mobile Food Vendor Permit Application and all required documents to the Victoria Fire Marshal’s Office along with the $100 permit fee.
